Mokko · Monthly plan terms
Terms & Conditions
Version: September 30, 2026
For fixed monthly plans that incorporate this version in a written service order.
Weekly AI ads. A fixed monthly fee and creative scope agreed before we start. Keep using your paid final deliverables when the collaboration ends.
1. Your agreement with Mokko
These terms govern Mokko’s business-to-business creative services under a fixed monthly fee. “Mokko”, “we” and “us” mean the service provider identified in your written service order. “Client” and “you” mean the business entering that order. The service order identifies the contracting parties, their registered details, the service start date and the agreed commercial parameters.
A collaboration starts when both parties accept a written service order incorporating these terms. Visiting this website or requesting a discovery call does not start a paid engagement. Anyone accepting on behalf of a business must have authority to bind it.
The service order and these terms together form the agreement. A specific provision in a mutually accepted service order prevails over a conflicting general provision here. Changes to an existing engagement require written agreement; updating this page does not retrospectively change your agreed fee or amounts already earned.
2. Weekly AI ads and creative analysis
Mokko produces AI advertising assets and analyzes performance to inform subsequent creative work. During an active collaboration, deliveries are weekly, subject to the agreed onboarding schedule and timely receipt of the materials, approvals and account access needed to perform the work.
Creative volume is agreed in your monthly plan, informed by your testing needs and available performance data. Weekly delivery does not mean an unlimited quantity or a fixed number of assets. Deliverables, formats and any revision arrangements are described in the service order.
Your team or agency launches and manages campaigns, selects budgets and funds advertising spend. Campaign management is not included. It may be agreed separately for larger projects by contacting hello@getmokko.com.
Testing plans and creative recommendations involve judgment and incomplete information. Mokko does not guarantee a minimum number of sales, revenue, profitability, return on ad spend or approval by an advertising platform.
3. Client responsibilities and approvals
You provide accurate brand and product information, usable source materials, required permissions and timely feedback. You are responsible for the legality of your products, offers, customer experience, campaign targeting and advertising claims. You must substantiate any claim you ask Mokko to include and review assets before publication.
You confirm that you have the rights to supply and authorize use of all submitted materials, including logos, images, testimonials and likenesses. Neither party may request or knowingly publish deceptive, unlawful or rights-infringing advertising.
Drafts supplied for review may be used internally for evaluation only. A file identified by Mokko as a final deliverable is accepted when you approve it in writing or first use it externally. Rejected or withdrawn drafts are not transferred or licensed for publication.
You remain responsible for ensuring that your employees, agencies and other representatives use the deliverables in accordance with these terms when acting on your behalf.
4. Pricing and payment
The service is provided for a monthly fee specified in the written service order. The order defines the creative scope, formats, production volume, currency and applicable taxes. Media spend is funded separately and is not included in the service fee.
The monthly fee covers the agreed creative services and rights in the final deliverables as described below. The fee does not vary with campaign results. Separately commissioned work requires a separate written price agreement.
Billing periods, payment deadlines and payment method are specified in the service order. These terms alone do not authorize access to or charges against a payment method.
Raise billing disputes promptly, normally within 30 days of receiving the invoice, with supporting details. The parties will reconcile substantiated errors, duplicate charges and agreed adjustments. Undisputed amounts remain payable. No fee may be changed retrospectively without both parties’ agreement.
5. Account access and creative analysis
Provide the agreed access to campaign performance so Mokko can analyze results and inform future creative work. Account data is used for creative analysis and service delivery.
Access must remain limited to the agreed work. Disconnecting access does not cancel fees already owed, but may affect the performance analysis available for subsequent deliveries.
You control your advertising accounts, campaign settings and media budget. Mokko’s access does not give Mokko ownership of those accounts or the underlying campaign data.
6. Final deliverables and intellectual property
You retain rights in your pre-existing brand materials and grant Mokko permission to use them as needed to provide the agreed services. Mokko retains its pre-existing technology, workflows, algorithms, templates and know-how.
Once you accept a final deliverable and pay the monthly fee covering its delivery, Mokko assigns to you all transferable economic intellectual-property rights that Mokko owns in that deliverable. This assignment is worldwide for the full period those rights exist and includes the rights to reproduce, publish, display, distribute, adapt and use the deliverable in your marketing, and to authorize agencies or other providers to do so on your behalf. You may continue using, editing and running paid ads with the final deliverable after the collaboration ends. No further fee is owed to Mokko for that continued use.
Before the corresponding monthly fee is paid, Mokko grants you a temporary, non-exclusive right to use an accepted final deliverable for your own marketing during the collaboration. If the collaboration ends while that fee remains unpaid, this temporary right ends until payment is made. Once paid, the assignment above takes effect and does not depend on future monthly fees or an ongoing collaboration.
The transfer covers accepted final deliverables, not rejected drafts, source or working files unless the service order lists them as deliverables, or Mokko’s pre-existing technology, workflows, algorithms, templates and know-how. Your pre-existing brand materials remain yours.
Some deliverables may contain third-party material or AI-generated output. Mokko transfers only rights it owns and can lawfully transfer. Any third-party component remains subject to its applicable license, which Mokko will identify before delivery if it limits your intended use or continued use after termination. Mokko will not include a component with such a limitation without your written agreement. AI-generated output may not be unique or protected by exclusive copyright; where no copyright exists, this clause does not create it, but Mokko places no contractual time limit on your use of the paid final deliverable.
7. Ending the collaboration
Either party may end the collaboration by written notice. Termination takes effect on receipt unless the notice specifies a later date or the parties agree otherwise. There is no fixed monthly cancellation fee. Mokko may also suspend work where required access or materials are missing, amounts due remain unpaid, or continued work would create a legal or platform-policy risk.
Ending the collaboration stops future services but does not revoke rights already transferred in paid final deliverables. You and providers acting on your behalf may keep using those deliverables, including in active advertisements, subject to any disclosed third-party restrictions.
Termination does not cancel outstanding fees. The final invoice and any adjustments follow the agreed service order. Rights in an accepted final deliverable whose corresponding fee is unpaid transfer when that fee is paid, including if payment occurs after termination. Until then, the temporary right described above does not continue after termination.
Payment obligations already incurred, confidentiality, rights in paid final deliverables, restrictions on unpaid deliverables and provisions necessary to settle disputes survive termination.
8. Confidential information and data
Each party must protect the other’s non-public business information and use it only to perform, administer or enforce the agreement. This includes account performance, credentials, unpublished creative, commercial plans and internal production methods. Disclosure is limited to authorized personnel and providers who need access and are bound by appropriate confidentiality duties, or where legally required.
Each party remains responsible for its data-protection obligations. Share only information needed for the service and avoid sending customer-level personal data unless expressly required and lawfully arranged. Where the work requires processing personal data on your behalf, the parties must put the necessary data-processing terms in place before that processing starts.
Account permissions and data retention must be proportionate to the agreed work and final reconciliation. Neither these terms nor a connection to Meta gives Mokko ownership of your customer data. Public use of your non-public results or testimonials requires your written permission.
9. Service limitations and responsibility
Mokko will perform the services with reasonable care and skill. Campaign outcomes also depend on media buying, product demand, pricing, stock, websites and platform decisions outside Mokko’s control. Third-party outages or reporting changes may delay delivery or reconciliation; the parties will cooperate on a reasonable resolution.
Each party is responsible for losses caused by its own breach, unlawful conduct or infringement of third-party rights, subject to applicable law. Neither party is responsible for the other’s independent campaign decisions or unapproved modifications. Notify the other party promptly of a relevant claim and cooperate reasonably to limit its impact.
Any financial liability cap or exclusion must be expressly stated in the service order. Nothing in these terms excludes liability or rights that cannot lawfully be excluded, including liability for fraud.
10. Notices, disputes and other terms
Send service, billing and termination notices to hello@getmokko.com and the operational contact specified in your service order. Mokko will send notices to the client contact designated in that order. Each party is responsible for keeping its contact details current.
The parties will first seek to resolve disputes in good faith using the service order, approved assets and supporting performance records. The governing law and competent courts must be identified in the service order. These terms do not impose US arbitration or waive rights available under applicable mandatory law.
The parties act as independent businesses. No employment, partnership or agency relationship is created. If a provision is unenforceable, the remainder continues to apply to the extent permitted by law. Failure to enforce a provision once is not a general waiver.
